Immigration: New USCIS Fees For Forms Including I-129, I-539, I-765, I-140, and I-485

A newly revised USCIS Fee Schedule, which is set to take effect on April 1, 2024, establishes new fee amounts for many common forms used for filing, including Form I-129, I-140, I-485, I- 539, and I-765. A table outlining the changes to the fee schedule, including the current fee, proposed fee, final fee, and percentage difference can be accessed on USCIS’s fee rule FAQ page.

Major fee changes include the I-129 H-1B fee increase from $460 to $780, I-129 L fee increase from $460 to $1,385, I-140 fee increase from $700 to $715, I-485 fee increase from $1,140 to $1,440, I-539 fee increase from $370 to $470, and I-765 fee increase from $410 to $520. Please also note that exceptions/exemptions to these fee increases include: (1) No fee change for I-129 H-1B filings for small employers (25 or fewer employees) and nonprofits; and (2) The I- 129 L-1 fee for small employers and nonprofits increased from $460 to $695. Along with the new fee schedule, USCIS will also publish updated forms to reflect the fee changes. These new form editions will take effect on April 1, 2024.
