Pankaj Malik is the Practice Leader of Warsaw Burstein’s immigration practice. Ms. Malik’s experience with immigration law began in the 1990’s with appearances before the United States consulate in India, assisting with corporate employment visas. She has travelled extensively to various international consulates and has represented employers and business entities with their employment immigration needs.

Her clients range from multi-national businesses to individuals seeking immigration assistance. (LPR) Some of her notable early successes include obtaining green cards, or legal permanent resident status for executive chefs, pastry chefs, sous chefs and line cooks for Michelin Star restaurants through different categories including the challenging ‘alien of extraordinary ability’ category. She has assisted red carpet fashion designers obtain green cards for staff and models. Ms. Malik has represented clients successfully and has helped them obtain visas and green cards in many categories of employment and business visas, including L, Eb1, Eb2, Eb3, Eb5, E1, E2, O, P, H1b, and TN.

Ms. Malik has represented foreign investors seeking to obtain legal status through business investments in the United States. She has helped clients negotiate source of income issues, and has prepared business analyst reports and other corporate documents required by individual businesses, in compliance with Eb5 guidelines. When appropriate, she works with consultants to obtain business plans, economists, reports and targeted employment area (TEA) designations.

Ms. Malik has represented numerous clients successfully in litigation, including removal and deportation proceedings in immigration court, before the BIA, and in federal district and circuit courts. She has represented many clients successfully with petitions for review, BIA appeals and motions, bond applications, habeas and mandamus writs, joint motions, trials, consular appeals before the State department, immigration court hearings, asylum proceedings and Stokes interviews.

Ms. Malik has represented numerous clients in connection with their individual applications for legal status, including family adjustments, waivers (under sections I-212, I-601 and provisional), DACA, U, VAWA (violence against women), J, and F visas, consular processing, citizenship and humanitarian parole.

Ms. Malik’s breadth of immigration law expertise makes her an invaluable advocate for her clients and an asset to navigate ever changing laws, policies and government rules, regulations and guidelines.
